Terms & Conditions

These Terms and Conditions govern your engagement with Sundial House and its financial education programmes. Please read them with care before booking or attending any session. By proceeding, you acknowledge that you have read and understood these terms.

1. Definitions

As used throughout these Terms and Conditions, the following expressions carry the meanings set out below:

  • "Sundial House", "we", "us", or "our" refers to Sundial House, operating from No. 23 Jalan Gasing Indah, Gasing Garden Court, 46000 Petaling Jaya, Selangor, Malaysia.
  • "Participant", "you", or "your" refers to the individual who books, attends, or otherwise engages with any of our programmes or services.
  • "Programme" or "Service" refers to any financial education session, reading programme, or multi-session engagement offered by Sundial House.
  • "Session" refers to a single scheduled meeting or appointment within a Programme.
  • "Content" refers to all materials, documents, summaries, written pictures, and worksheets produced or shared during or after a Programme.
  • "Agreement" refers to these Terms and Conditions, together with any booking confirmation or written correspondence confirming your enrolment.

2. Acceptance of Terms

By contacting Sundial House to enquire about or book a Programme, by paying any fee, or by attending a Session, you confirm that:

  1. You have read and understood these Terms and Conditions in their entirety.
  2. You are at least 18 years of age and have full legal capacity to enter into a binding agreement.
  3. You are entering into this Agreement on your own behalf or with proper authorisation to act on behalf of a household.
  4. You accept these Terms as the governing basis for all dealings between yourself and Sundial House.

3. Service Description

Sundial House provides financial education programmes for Malaysian households. Our current offerings are as follows:

  • One-Month Cash-Flow Reading (RM 430): A single two-hour session in which the participant and facilitator read one complete month of household transactions together.
  • Household Insurance Reading Programme (RM 1,720): A four-session programme for adults who hold Malaysian household insurance policies and wish to read those documents with greater confidence.
  • Household Picture Engagement (RM 4,350): A four-month engagement producing a concise written picture of the household's present financial position and considered five-year direction.

Programmes are delivered in person at our Petaling Jaya premises unless an alternative arrangement is confirmed in writing. Availability is subject to the facilitator's schedule. We reserve the right to adjust programme content as circumstances or participants' needs require, provided the substance of the engagement is not materially altered.

4. Participant Responsibilities

To make good use of any Programme, participants are expected to:

  1. Arrive at Sessions at the agreed time. Where a Session must be rescheduled, at least 48 hours' notice is requested.
  2. Bring all documents requested in advance by the facilitator (such as bank statements, policy documents, or transaction records) in an organised and legible form.
  3. Engage with the Programme in good faith, understanding that the outcome depends substantially on the quality of information shared.
  4. Keep all written materials, summaries, and notes produced during a Programme for their personal use and not distribute them commercially.
  5. Understand that Sundial House's facilitation is educational in nature and does not constitute regulated financial advice, insurance broking, or investment advisory services.

The following conduct is not appropriate within our programmes:

  • Recording sessions without prior written consent from the facilitator.
  • Sharing confidential details of other participants (where group settings may occur in future).
  • Using the Programme to obtain advice on specific financial products, tax matters, or legal disputes — these require qualified professionals.
  • Misrepresenting financial information in a way that causes the session to be conducted on a false basis.

5. Payment Terms

  1. Fees: Programme fees are stated in Malaysian Ringgit (RM) and are inclusive of all materials provided during Sessions. Fees are subject to change; any change will be communicated before a booking is confirmed.
  2. Payment timing: For single-session programmes, payment is due prior to or on the day of the Session. For multi-session programmes, a payment schedule will be agreed at the time of booking.
  3. Accepted methods: Bank transfer to the account details provided in the booking confirmation. Receipts will be issued on request.
  4. Cancellation by participant: If you cancel more than 5 business days before a Session, a full refund of amounts paid for that Session will be offered. Cancellations with less than 5 business days' notice may forfeit the session fee at our discretion, depending on circumstances.
  5. Cancellation by Sundial House: If we cancel or reschedule a Session, you will be offered an alternative date or a full refund of any amounts paid for that Session.
  6. Non-completion: Where a participant withdraws from a multi-session programme after Sessions have commenced, fees for completed Sessions are non-refundable. Fees for future Sessions not yet conducted will be reviewed on a case-by-case basis.

6. Engagement-Specific Terms

The following apply specifically to our programmes:

  • Session notes and summaries prepared by the facilitator during or after a Session are provided for the participant's personal reference and do not constitute a professional report, regulated advice, or a binding recommendation.
  • Insurance Reading Programme: Sessions are structured around understanding policy documents. Sundial House does not recommend, endorse, or compare specific insurance products or providers. Product decisions remain entirely with the participant.
  • Household Picture Engagement: The written picture produced at the conclusion of this engagement is intended as a reference document for the household. It reflects the information provided during sessions and represents a point-in-time reading, not a projection or forecast.
  • Confidentiality: We treat all financial and personal information shared with us as confidential and will not disclose it to third parties without your consent, except as required by Malaysian law.

7. Intellectual Property

  1. All programme frameworks, methodology materials, templates, and written content developed by Sundial House remain our intellectual property.
  2. Participants are granted a limited, non-exclusive, non-transferable licence to use materials provided to them solely for their personal household financial education purposes.
  3. Reproduction, redistribution, or commercial use of any Sundial House materials — including session frameworks, reading guides, or written pictures — without prior written consent is not permitted.
  4. Documents brought to Sessions by participants (bank statements, policy documents, etc.) remain the property of the participant. We do not retain copies beyond the duration of the engagement without consent.

8. Disclaimers

  1. Educational nature: All Sundial House programmes are educational. Nothing communicated in any Session, document, or correspondence constitutes regulated financial advice, investment advice, tax advice, legal advice, or insurance advice as defined under Malaysian law.
  2. No outcomes assured: Financial literacy education may improve understanding and confidence in managing household finances. However, no specific financial outcome, improvement in financial position, or result of any kind is assured or implied.
  3. Professional referrals: For matters requiring regulated advice — including investment decisions, insurance product selection, tax planning, or legal questions — we recommend engaging a licensed professional.
  4. Accuracy of participant information: The quality and relevance of a Session depends on the accuracy and completeness of information shared by the participant. Sundial House is not responsible for conclusions or notes based on incomplete or inaccurate information.
  5. Website content: Information on our website is provided for general informational purposes and may not reflect current programme details, pricing, or availability. Please confirm details directly before booking.

9. Limitation of Liability

  1. To the fullest extent permitted under Malaysian law, Sundial House's total liability to any participant arising from or in connection with a Programme shall not exceed the total fees paid by that participant for the relevant Programme.
  2. We shall not be liable for any indirect, consequential, special, or incidental loss or damage, including loss of income, loss of savings, or any financial decisions made following attendance at a Session.
  3. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
  4. We are not liable for failures or delays in delivering a Service caused by circumstances outside our reasonable control, including illness, natural events, or disruption to public services.

10. Indemnification

You agree to indemnify and hold Sundial House, its facilitators, and associates harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising from your misuse of Programme materials, your breach of these Terms, or any information you provide that is inaccurate, misleading, or obtained without proper authority.

11. Termination

  1. By participant: You may withdraw from a Programme at any time by notifying us in writing. Fees already paid for completed Sessions are non-refundable. Fees for future Sessions will be handled as described under Payment Terms.
  2. By Sundial House: We reserve the right to end a participant's engagement if conduct is disruptive, if information provided is found to be materially misleading, or if the participant's approach makes productive facilitation impractical. In such cases, fees for Sessions not yet conducted will be refunded.
  3. Survival: Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Dispute Resolution) survive any termination of this Agreement.

12. Dispute Resolution

  1. Governing law: These Terms and any dispute arising from them are governed by the laws of Malaysia.
  2. Jurisdiction: Both parties agree to submit to the exclusive jurisdiction of the courts of Malaysia, with the courts of Selangor as the preferred venue where applicable.
  3. Informal resolution: Before commencing any formal proceedings, both parties agree to attempt to resolve any dispute through direct discussion. Please contact us at legal@{{DOMAIN}} in the first instance.
  4. Consumer rights: Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act 1999 (Malaysia) or other applicable Malaysian consumer protection legislation.

13. General Provisions

  1. Entire agreement: These Terms, together with any booking confirmation, constitute the entire agreement between the parties regarding a Programme and supersede all prior discussions or representations.
  2. Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or removed, without affecting the remaining provisions.
  3. Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it subsequently.
  4. Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  5. Notices: Formal notices under these Terms should be sent by email to legal@{{DOMAIN}} or by post to our Petaling Jaya address.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our programmes, applicable law, or operational practice. Where changes are material, we will communicate them by email to participants who have an active or recent booking. For others, the updated Terms will be published on this page with a revised Last Updated date.

Continued engagement with Sundial House after the effective date of any changes constitutes acceptance of the revised Terms. If you have questions about any update, please contact us before proceeding.
